Terms of Service

1. Accepting these terms

These Terms of Service (the "Terms") are an agreement between you and the operator of OptimizeResume.ai ("Optimize Resume", "we", "us"). By running a scan, creating an account or otherwise using the service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.

2. Who may use the service

You must be at least 16 years old. If you are under the age of majority where you live, you may use the service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. You may not use the service if you have been suspended from it or if doing so would break a law that applies to you.

3. What the service does

You provide a resume and a job description. Optimize Resume builds a set of criteria from that posting, looks for evidence of each criterion in your resume, and returns a score, an explanation, strengths, gaps and suggested improvements. Some features run without an account; saving results and running more scans requires one.

4. What the score is, and what it is not

The Resume Evidence Score is Optimize Resume's own rubric. It reflects how much evidence we could find in the resume you gave us for the criteria we drew from the job description. It is not an employer's applicant tracking system (ATS) score, not a measure of how any employer or recruiter will read your resume, not a probability of being hired, and not a guarantee of an interview, an offer, or any other outcome. The score can change when the same resume is scanned again, because AI output varies.

5. AI output and your responsibility to review it

Results are generated with the help of artificial intelligence. AI can be incomplete, inaccurate, out of date, or simply wrong, and it can misread the text you provide. You must independently review every score, explanation and suggestion before relying on it or using it in your resume or your job search. You, not Optimize Resume, decide what goes into any document you submit to an employer.

6. Not professional advice

Optimize Resume does not provide legal, career, employment, recruiting, financial or other professional advice, and nothing in the service creates a professional or fiduciary relationship. If you need advice for your situation, consult a qualified professional.

7. Truthful use

We never invent experience for you, and you agree not to use the service, or its suggestions, to claim experience, qualifications, skills, results or credentials that you do not actually have. A suggestion to add or reword something is only appropriate if it is true of you. You are solely responsible for the accuracy and completeness of any resume you submit to us or to anyone else.

8. Your content

You keep ownership of the resume text, job descriptions and other material you provide ("your content"). You grant us a limited, non-exclusive, worldwide, royalty-free licence to process, store (when you choose to save), transmit to our service providers, and display your content back to you, solely to operate, secure, support and improve the service as described in the Privacy Policy. You confirm that you have the right to submit your content, including any job description you paste from a third party, and that it does not contain information you are not permitted to share.

9. Accounts and security

You are responsible for keeping your password confidential and for activity that happens under your account. Use accurate information when you sign up, keep one account per person, and tell us promptly if you believe your account has been accessed without your permission. We may require email confirmation before an account is fully active.

10. Free scans, extra scans and referrals

Scans without an account are free but limited in number and rate-limited to prevent abuse. Free accounts receive a monthly allowance of scans (currently 3) and each analysis uses scans (currently 1). Monthly allowances do not roll over. Our referral programme grants bonus scans to you and a person you invite only after that person creates a genuinely separate account and completes their first analysis, subject to a monthly cap. Scans have no cash value, cannot be transferred or refunded, and monthly allowances expire at reset. Purchased extra scans persist until used. We may change allowances, costs, caps and programme rules at any time, and we may remove scans obtained through self-referral, duplicate accounts or other gaming.

11. Things you may not do

• Submit content that is unlawful, infringing, or that you have no right to share.
• Upload personal data about other people without a lawful basis to do so.
• Scrape, crawl, or access the service with automated tools except as we allow.
• Probe, bypass or overload our rate limits, security or anti-abuse measures.
• Create multiple or fake accounts, refer yourself, or share accounts to farm scans.
• Attempt to extract our prompts, rubric logic or models, or to build a competing service from them.
• Reverse engineer, decompile or interfere with the service or its infrastructure.
• Use the service to discriminate unlawfully or to deceive an employer.

12. Our intellectual property

The service, including its software, rubric design, prompts, scoring methodology, interface, text and branding, belongs to us or our licensors and is protected by intellectual property laws. Apart from the rights expressly given to you in these Terms, we reserve all rights. Feedback you send us may be used without obligation to you.

13. Third-party content and services

Job descriptions you paste come from third parties and remain subject to their terms. We do not verify them and we are not responsible for their accuracy or for the hiring practices of any employer. The service relies on third-party providers, including AI model and hosting providers, which we do not control.

14. Privacy

Our Privacy Policy explains what we collect, how it is used, and the choices you have. It forms part of these Terms.

15. Changes to the service

The service is still evolving. Features, limits, scoring behaviour and wording may change, be paused or be withdrawn at any time, with or without notice. Do not rely on the service as your only copy of anything.

16. Suspension and termination

You may stop using the service at any time and delete your account from your account page. We may suspend or terminate access, remove content, or withhold credits if we reasonably believe you have broken these Terms, created risk or legal exposure for us or others, or if we discontinue the service. Sections that by their nature should survive (including 4 to 8 and 17 to 21) continue after termination.

17. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that any score, suggestion or output is accurate, complete or will lead to any employment result.

18. Limitation of liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, contractors and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost employment, lost data or goodwill, arising out of or relating to the service or these Terms, even if advised of the possibility. Our total liability for all claims relating to the service will not exceed the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars (US $100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

19. Your indemnity

You agree to defend, indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your content, your misuse of the service, your breach of these Terms, or any false or misleading statement you make to an employer or other third party using output from the service.

20. Changes to these Terms

We may update these Terms. When we do, we will change the date and version at the top of this page and, for material changes, give notice in the service or by email if we have your address. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the service and delete your account.

21. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us about the service and replace any earlier agreement on the same subject.
